COVID-19 LIABILITY RELEASE FORM
If you choose to participate in a Chesapeake College athletics program, you agree as follows:
1. You confirm that your participation in an athletics program is voluntary. It is your decision to participate in this educational program. You may elect to cease participation at any time without any adverse consequence to your current or future student status in the health professions program or Chesapeake College as a result of that decision.
2. You have represented to the College that you are fully aware of the extreme risks in participation, and that you are also aware that conditions in the area may rapidly change for the worse. You have reviewed the Maryland Department of Health website information, the WHO website information, and the CDC website information.
3. You have agreed to follow, at a minimum, Chesapeake College’s attached procedures, as may be amended and updated without notice by Chesapeake College. In addition, the College may issue additional protocols and requirements from time to time designed to address health risks to you and other members of the college community, and, if issued, you agree to take all reasonable measures to comply with these additional requirements. Failure to abide by any one of these may result in revocation of this opportunity and/or disciplinary action.
4. Despite all precautions and safeguards implemented by Chesapeake College, you acknowledge that there is serious risk of exposure and infection throughout your participation as well as during travel to and from the college.
5. You understand that possible risk factors for developing severe illness are not yet clear. COVID-19 has caused severe disease and death in patients who developed pneumonia.
6. To the fullest extent permissible by law, you attest that you have actual and complete knowledge of all the risks, dangers, and hazards (“Risks”) of participating in activities in the athletics program.
YOU UNDERSTAND THAT IF THE RISKS MANIFEST, THEY WILL RESULT IN INJURY (MINOR, SERIOUS, OR MORTAL) TO YOU. Possessing subjective knowledge of the risks of participation, and appreciating those risks, you, nevertheless, choose to participate and you voluntarily assume those risks. You hereby release and hold harmless Chesapeake College, the State of Maryland, their regents, officers, agents, servants, faculty, administrators, and employees acting as such (the “Releasees”), who through acts, omissions, negligence, or carelessness or otherwise might be liable to you (or your heirs or assigns) for damages.
YOU FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES FROM ANY AND ALL LIABILITY FOR ANY HARMS, INJURIES, DAMAGES, CLAIMS, ACTIONS, SUITS, CAUSES OF ACTION, JUDGMENTS, COSTS, DEMANDS, AND EXPENSES OF ANY NATURE WHATSOEVER WHICH YOU MAY HAVE, OR WHICH MAY HEREAFTER ACCRUE TO YOU, ARISING OUT OF, OR RELATED IN ANY WAY TO, ANY LOSS, DAMAGE, OR INJURY, INCLUDING BUT NOT LIMITED TO SUFFERING AND DEATH, THAT MAY BE SUSTAINED BY YOU, OR TO ANY PROPERTY BELONGING TO YOU, WHETHER CAUSED BY THE ACTS, OMISSIONS, NEGLIGENCE, OR CARELESSNESS OF THE RELEASEES, AND ON RELEASEES’ BEHALF AND IN RELEASEES’ NAME(S), DEFEND AT YOUR OWN EXPENSE ANY SUCH CLAIMS, ACTIONS, SUITS, CAUSES OF ACTION, JUDGEMENTS, COSTS, DEMANDS DESCRIBED ABOVE, OR WHILE IN, ON, UPON, OR IN TRANSIT TO OR FROM CHESAPEAKE COLLEGE.
7. Accordingly, you understand and agree that Chesapeake College and the State of Maryland (including any Regents, officers, agents, servants, faculty, administrators, and employees acting as such) provides no assurance and assumes no responsibility or liability, in whole or in part, for your participation in the athletics program. You hereby waive and release the Releasees (whether in their professional or personal capacity or otherwise) from any actions, claims, liabilities, and damages arising from or relating to your participation in the athletics program, and all associated activities, including, without limitation, any damages for personal injury, illness, death, or property loss that you may sustain in connection with your travel to or from, or while on location at Chesapeake College.
8. You conclude that the risks of participation in the athletics program are acceptable to you and are outweighed by your desire to participate at this time.
